I. Application
These terms apply to all transportation of goods by for-hire highway carriers licensed under the Motor Vehicle Transport Act (Canada, R.S.C. 1970, M-14) or provincial statutes, excluding used household goods, livestock, bus parcel express shipments, and personal luggage of bus passengers.
II. Bill of Lading
Each shipment must be accompanied by a Bill of Lading, with clear details such as the consignee’s name and destination. The Bill of Lading must be signed by both the consignor and the carrier, acknowledging all terms and conditions.
III. Conditions of Carriage
Liability of Carrier
The carrier is responsible for any loss or damage to goods, unless otherwise specified in the agreement.
Liability of Originating and Delivering Carriers
Both the originating and delivering carriers are liable for the goods while in their custody, ensuring any damage or loss is compensated.
Recovery from Connecting Carrier
The originating or delivering carrier can recover damages from any intermediary carrier who may be responsible for the loss or damage during transport.
Exceptions from Liability
The carrier is not responsible for losses caused by natural events, public enemies, defects in the goods, or other specified exceptions.
Delay
The carrier is not bound to deliver goods by a specific vehicle or time unless stated in the Bill of Lading.
Routing by Carrier
The carrier may forward goods using non-licensed vehicles when necessary, with the same liability as licensed vehicles.
Stoppage in Transit
Goods stopped and held in transit at the request of the party are held at their risk.
Valuation & Maximum Liability
The carrier’s liability is calculated based on the value of goods at the time of shipment, with a maximum of $4.41 per kilogram, unless a higher value is declared.
Consignor’s Risk
If goods are carried at the risk of the consignor, this agreement covers only risks associated with transportation but does not absolve the carrier from negligence.
Notice of Claim
Claim must be made within 30 days delivery, non-delivery shipments must be submitted 1 month.
Freight Charges
Freight charges must be paid before delivery. If discrepancies in shipment occur, charges will be adjusted based on the actual shipment.
Dangerous Goods
Shipments containing dangerous goods must be disclosed to the carrier. The consignor will indemnify the carrier for any loss or damage resulting from such goods.
Undelivered Goods
If goods cannot be delivered, the carrier will notify the consignor and store the goods at the consignor’s risk and expense.
Return of Goods
Disposable instructions must be provided within 5 days of undelivered goods and will be stored at the consignor’s cost until delivered, then carrier may return.
